The Photographer is responsible for providing the client a photograph service and products as agreed by both parties before the wedding. Coverage always includes bride getting ready right through to call for the meal unless otherwise agreed by both parties before the wedding takes place. The client will pay the photographer the agreed fee subject to the following terms;
PAYMENT AGREEMENTS (1.2)
An initial €300 (or another amount as agreed between parties) booking fee to secure the wedding date, made payable at time of booking. The booking fee is non-refundable or transferable in the event of cancellation, it being the agreed loss suffered by the photographer due to cancellation. All cancellations must be in writing or by email to email@example.com.
Final payment after the booking fee has been paid is due no later than 4 weeks before the wedding. If the payment has not been paid on the due date a late fee of 10% of overall cost applies. The photographer holds the rights not to show to document the wedding if the remaining payment has not been paid on or before the date that is 4 weeks before the wedding date. Terms and Conditions must be read and agreed before the wedding date otherwise the photographer holds the rights not to attend.
Photo editing period can take anything from 8 to 12 weeks depending on peek seasons. After this time you will get a copy of your wedding photographs on disc or USB.
PHOTOGRAPHY PACKAGES 2.2
As part of all meathphotos.ie wedding options you will receive all edited images from your wedding day on disc or USB. The images will be in full printable JPEG resolution. The amount of images you will receive will depend on each individual wedding and there is no set amount.
The client at any time is unable to view the RAW unedited version of the images taken on the wedding day. The client will receive images after they have been edited. It is the bride and grooms responsibility to keep copies of their wedding photos. MeathPhotos.ie keep copies for up to 6 months after the wedding date. It is not the photographer's responsibility to keep copies of the images.
All images will be adjusted for exposure, brightness, contrast and sharpness etc. The photographer's judgement regarding these corrections and the number of images put forward to the client shall be deemed correct. The photographer will edit the images to what they feel is an acceptable high standard. Extra retouching, digital manipulation artist finishing and changes from b&w to colour or colour to b&w is available to the client at additional cost.
The entire copyright of the photographs is retained by the photographer at all times throughout the world. Where a disc/usb of photographs has been provided to the bride and groom as part of their wedding collection, these photographs are able to be printed and displayed online for personal use but not commercial use.
The photographer retains the right in all cases to use the photographs in any manner at any given time and in any part of the world for the purposes of advertising or otherwise promoting their work unless otherwise discussed and agreed with the client.
The coverage begins and ends at a time agreed between the couple and the photographer prior to the wedding. A wedding time form will be provided a few weeks before the date of the wedding to ensure we have all the correct times, addresses and info needed.
For bookings involving a church ceremony at certain venues the photographers movements are sometimes restricted by the official in charge and can even be restricted by a booked videographer. Therefore the viewing point from which the photographer is able to cover the ceremony may not be the photographer's choice and the photographer cannot accept responsibility for any obstructed view should this be the case.
Due to the extent of differences in clients preferences it is not the photographers responsibility to take any desired people in photographs. To keep to the timescale of the day and so that the photographer is able to stay true to the documentary style of their work, formal group shots are kept to a bare minimum and the photographer works with immediate family only. Brothers, sisters, their parents and children, the bride and grooms mum and dad and grandparents. Provided there is enough time before the clients are called for their meal the clients are able to use this time to mingle with guests or for more formal line ups again only as long as there is enough time.
It is important for the client to understand that they book the photographer based on their photography work and creative style. It is not possible for the photographer to recreate another photographers work or ideas through selected images by the client.
IMAGE SIZE, COLOUR, STYLE AND COMPOSITION
All image sizes are approximate. The photographer will provide a pleasing colour balance but cannot guarantee exact colour matching. It is sometimes not possible to record on camera or in print the exact colour as seen by the human eye. There is no right to reject on the bases of style or composition. Photography editing styles may be subject to change.
If for any reason the photographer is unable to complete the coverage, the photographer reserves the right to appoint another photographer to attend on his/her behalf to undertake the photography in their place.
A meal is not required for the photographers but if the client would like to provide a meal it is always appreciated. If a meal is to be provided please ensure photographers are away from the wedding party where possible, ie; at a bar or restaurant. If a meal will not be provided the photographers will allow 1.5 hours during the day set aside to have dinner (usually when the wedding party are having their meal).
Wedding date is only secure once Terms and Conditions have been agreed, a booking form filled out and a €300 (or another amount as agreed between parties) non-refundable booking fee has been paid. The photographer holds the right not to photograph the wedding if any of these mentioned above have not been completed. The photographer also holds the right not to photograph the wedding if the remaining payment has not been paid 4 weeks before the date of the wedding. The photographer also holds the rights not to release any photographs if this is the case.
The photographer agrees to indemnify the client against all expenses, damages, claims and legal costs arising out of any failure by the photographer to obtain any clearances for which they were responsible in respect of third party copyright works, trademarks, designs or other intellectual property. The photographer shall only be responsible for obtaining such clearances if this has been expressly agreed before the day of the wedding. In all other cases the client shall be responsible for obtaining such clearances and will indemnify the photographer against all expenses, damages, claims and legal costs arising out of any failure to obtain such clearances.
